§ 1

Preliminary provisions

The Kovalshop online store available at the address www.kovalshop.com, is run by Tomasz Kowal, who runs a business under the name KOVAL Tomasz Kowal, entered into the Central Register and Information on Economic Activity (CEIDG) maintained by the minister competent for economy, NIP 6443112095 REGON 366684207.

These Regulations are addressed to Consumers and specify the rules and procedure for concluding a Distance Selling Agreement with the Consumer via the Online Store Kovalshop.com.

These Regulations are the regulations referred to in art. 8 of the Act on the provision of electronic services.

§ 2

definitions

Client - a natural person concluding an agreement with the Seller as part of the Store, the subject of which is not directly related to its business or professional activity.

Seller - a natural person running a business under the name KOVAL Tomasz Kowal, entered into the Central Register and Information on Economic Activity (CEIDG) kept by the minister competent for economy, NIP 6443112095, REGON 366684207.

Entrepreneur - a natural person, a legal person and an organizational unit that is not a legal person, the separate law of which grants legal capacity, performs in its own name an economic activity that uses the Store.

Store - an online store run by the Seller at the address www.kovalshop.com

Contract concluded at a distance - an agreement concluded with the Customer as part of an organized system of concluding distance contracts (as part of the Store), without simultaneous physical presence of parties, with the exclusive use of one or more means of distance communication up to the conclusion of the contract, inclusive.

Regulations - these Regulations of the Store.

Order - Customer's declaration of intent submitted via the Order Form and aiming directly at concluding a Product Sales Agreement or Products with the Seller.

Account - customer account in the store, it contains data provided by the customer and information about orders placed by him in the store.

Registration form - a form available in the Store, enabling the creation of an Account.

Order form - an interactive form available in the Store that allows placing an Order, in particular by adding Products to the Basket and defining the terms of the Sales Agreement, including the method of delivery and payment.

Shopping Cart - an element of the Store's software in which the Products selected for purchase are displayed by the Customer, and it is also possible to set and modify the Order data, in particular the quantity of products.

Product - a movable item available in the Store / a service being the subject of the Sales Agreement between the Customer and the Seller.

Sales Agreement - Product sales contract concluded or concluded between the Customer and the Seller via the Online Store. The Sale Agreement also means - applying to the Product features - a contract for the provision of services and a contract for specific work.

§ 3

§ 4

General information

1. These Regulations specify in particular:

a) the rules for registering and using the account as part of the Online Store;

b) terms and conditions of placing orders for products available on the Online Store, by electronic means;

c) the principles of concluding sales contracts with the use of services provided as part of the Online Store.

2. To use the Store, including viewing the Store's assortment and placing orders for Products, you will need:

a) A device equipped with an efficient operating system (Windows, Linux, IOS or other), allowing access to the Internet, with a Google Chrome Internet browser, Internet Explorer, Opera, Safari, Mozilla Firefox or other compatible,

b) active e-mail account (e-mail),

c) enabled cookies.

3. In order to take advantage of the Online Store, the Customer should get access to the terminal device with access to the Internet.

4. The Seller, in the widest extent permitted by law, is not liable for any disruptions to this interruption in the functioning of the Store caused by force majeure, unlawful activities of third parties or incompatibility of the Online Store with the Customer's technical infrastructure.

5. Browsing the Store's assortment does not require creating an Account. Placing orders by the Customer for Products in the Store's assortment is possible after creating an Account in accordance with the provisions of § 5.

§ 5

Creating an Account in the Store

1. To create an Account in the Store, you must complete the Registration Form. It is necessary to provide the following data: active e-mail address, first name, last name and own password.

2. Creating an Account in the Store is free.

3. Logging in to the Account is done by entering the login and password set in the Registration Form.

4. The Customer may, at any time, without giving any reason and without incurring any fees, remove the Account by sending a relevant request to the Seller, in particular via e-mail or in writing to the addresses provided in § 3.

§ 6

The rules for placing orders

In order to place an Order:

a) log in to the Store

b) select the Product being the subject of the Order, its possible attributes (color, type, quantity) and then click the "Add to basket" button;

c) choose the delivery method and one of the available payment methods and, depending on the method of payment, pay for the order within a specified period,

d) click the "I confirm the order" button

§ 7

Payment methods and prices.

1. The customer can use the following payment methods:

a) Payment by bank transfer to the bank account number: KOVAL Tomasz Kowal 52 2490 0005 0000 4530 6418 4919, giving the order number in the title

b) Electronic payments in the PayPal system

c) Payment by credit card - Visa, Visa Electron, MasterCard, MasterCard Electronic, Maestro - also via PayPal.

2. Commodity prices are given in Polish zlotys, euros or dollars, depending on which currency the user has set as the default currency.

§ 8

Offered delivery methods

1. The Customer may use the following methods of delivery or collection of the ordered Product:

a) Postal package - Poczta Polska

b) Courier shipment - courier company DPD

c) Shipment using InPost parcels

§ 9

Execution of a sales contract

1. Conclusion of the Sales Agreement between the Customer and the Seller takes place after the Customer has placed an Order using the Order Form in the Online Store in accordance with § 5 of the Regulations.

2. After placing the Order, the Seller immediately confirms its receipt and at the same time accepts the Order for execution. Confirmation of receipt of the Order and its acceptance for implementation shall take place by sending by the Seller an e-mail message to the Customer's e-mail address provided during the ordering, which includes the Seller's statement on receipt of the Order and its acceptance for execution and confirmation of the Sales Agreement. Upon receipt of the above e-mail by the Customer, a Sales Agreement is concluded between the Customer and the Seller.

3. In the case of payment by bank transfer, electronic payment or payment by a payment card, the Customer is obliged to make payment within 7 calendar days from the date of the Sale Agreement - otherwise the order will be canceled.

4. The product will be sent by the Seller within the time specified in its description, in the manner chosen by the Customer when placing the Order.

5. The beginning of the delivery of the Product to the Customer counts as follows:

a) If the Customer chooses the method of payment by bank transfer - from the date of crediting the Seller's bank account.

b) If the Customer selects electronic payment or payment card payment - from the moment of receipt to the e-mail address, the correct confirmation of the payment status.

§ 10

The right to withdraw from the contract

1. The Customer may withdraw from the Sales Agreement within 100 days without giving any reason.

2. The running of the deadline specified in paragraph 1 begins with the delivery of the Product to the Customer or a person indicated by him.

3. The Customer may withdraw from the Agreement by returning the purchased goods to the Seller and informing the Seller about this fact via e-mail, telephone or letter attached to the returned goods. To comply with the deadline for withdrawal from the Agreement, it is sufficient for the Consumer to send a statement before the expiry of that period.

4. Effects of withdrawing from the Agreement:

a) In the event of withdrawal from the Agreement, the Seller returns to the Customer, not later than within 14 days from the date of receipt of the Customer's statement of withdrawal from the Agreement, all payments made by him, including the cost of delivering the item, with the exception of additional costs resulting from the Customer's choice the method of delivery other than the cheapest usual delivery method offered by the Seller.

b) The reimbursement shall be made by the Seller using the same payment methods as were used by the Customer in the original transaction, unless the Customer explicitly agreed to another solution, which shall not entail any costs for him.

c) The Seller may withhold the reimbursement of the payment until receiving the Product back or until it has been provided with proof of its return, depending on which event occurs first.

d) The Customer should return the Product to the address of the Seller specified in these Regulations immediately, not later than 14 days from the day on which he informed the Seller about the withdrawal from the Agreement. The deadline will be respected if the Consumer sends the Product back within 14 days.

§ 11

Complaints

1. The seller is liable to the Customer who is a consumer within the meaning of art. 22 [1] of the Civil Code, under the warranty for defects in the scope specified in the Civil Code, in particular in art. 556 and art. 556 [1] -556 [3] and subsequent Civil Code.

2. Complaints arising from violation of Customer rights guaranteed by law or under these Regulations should be directed to office@kovalshop.com, the Seller undertakes to review each complaint within 10 days. Failure to examine the complaint within the above deadline means that it is justified.

3. Seller - Bzik Tomasz Kowal is a producer of goods available in the Store.

§ 12

Complaints regarding the provision of electronic services

1. The Seller undertakes the necessary actions to ensure fully correct operation of the Store, to the extent that results from current technical knowledge and undertakes to remove as soon as possible any irregularities reported by customers.

2. The Customer is obliged to immediately notify the Seller about any irregularities or interruptions in the functioning of the Store.

3. Irregularities related to the functioning of the Store may be reported by e-mail to the following address: office@kovalshop.com

4. In the complaint application, the Customer should provide his name and surname, correspondence address, type and date of irregularities related to the functioning of the Store.

5. The Seller undertakes to consider each complaint within 10 days. Failure to examine the complaint within the above deadline means that it is justified.

§ 13

Out-of-court ways to handle complaints and redress

1. Detailed information on the Consumer's possibility of using the extrajudicial means of dealing with complaints and pursuing claims and the rules of access to these procedures are available at the offices and on the websites of poviat (municipal) consumer ombudsmen, social organizations, whose statutory tasks include consumer protection, Voivodship Inspectorates of the Trade Inspection and the following Internet addresses of the Office of Competition and Consumer Protection:

2. The consumer has the following exemplary possibilities of using extrajudicial means of dealing with complaints and redress:

a) The consumer is entitled to apply to a permanent amicable consumer court, referred to in art. 37 of the Act of 15 December 2000 on the Trade Inspection (Journal of Laws from 2014, item 148, as amended), with a request to settle a dispute arising from the Contract concluded with the Seller.

b) The consumer is entitled to apply to the provincial inspector of Trade Inspection, pursuant to art. 36 of the Act of 15 December 2000 on the Trade Inspection (Journal of Laws from 2014, item 148, as amended), with a request to initiate mediation proceedings regarding the amicable settlement of the dispute between the Consumer and the Seller.

c) The consumer may obtain free assistance in settling the dispute between him and the Seller, also using the free help of the poviat (municipal) consumer ombudsman or social organization, whose statutory tasks include consumer protection (including Consumer Federation, Association of Polish Consumers) .

§ 14

Privacy policy.

This Privacy Policy sets out the rules for the processing and protection of personal data provided by Users in connection with the use of the KovalShop Online Store.

§ 15

Final Provisions

1. Contracts concluded through the Online Store are concluded in Polish.

2. The Seller reserves the right to make changes to the Regulations for important reasons, that is: changes in the law, changes in methods of payment and delivery - to the extent to which these changes affect the implementation of the provisions of these Regulations. The Seller shall inform the Customer about each change at least 7 days in advance.

3. In matters not covered by these Regulations, generally applicable provisions of Polish law shall apply, in particular: the Civil Code; Act on the provision of electronic services; Consumer Rights Act, the Act on the Protection of Personal Data.

4. The customer has the right to use extrajudicial means of dealing with complaints and redress. To this end, it may lodge a complaint via the EU ODR online platform at: http://ec.europa.eu/consumers/odr/.

§ 1

Postanowienia wstępne

Sklep internetowy Kovalshop dostępny pod adresem internetowym www.kovalshop.com, prowadzony jest przez Tomasza Kowala, prowadzącego działalność gospodarczą pod firmą KOVAL Tomasz Kowal, wpisaną do Centralnej Ewidencji i Informacji o Działalności Gospodarczej (CEIDG) prowadzonej przez ministra właściwego ds. gospodarki, NIP 6443112095 REGON 366684207.

Niniejszy regulamin skierowany jest do Konsumentów i określa zasady i tryb zawierania z Konsumentem Umowy Sprzedaży na odległość za pośrednictwem Sklepu Internetowego Kovalshop.com.

Niniejszy Regulamin jest regulaminem, o którym mowa w art. 8 Ustawy o świadczeniu usług drogą elektroniczną.

Definicje

Przedsiębiorca - osoba fizyczna, osoba prawna i jednostka organizacyjna niebędąca osobą prawną, której odrębna ustawa przyznaje zdolność prawną, wykonująca we własnym imieniu działalność gospodarczą, która korzysta ze Sklepu.

Sklep - sklep internetowy prowadzony przez Sprzedawcę pod adresem internetowym www.kovalshop.com

Umowa zawarta na odległość - umowa zawarta z Klientem w ramach zorganizowanego systemu zawierania umów na odległość (w ramach Sklepu), bez jednoczesnej fizycznej obecności stron, z wyłącznym wykorzystaniem jednego lub większej liczby środków porozumiewania się na odległość do chwili zawarcia umowy włącznie.

Regulamin - niniejszy regulamin Sklepu.

Zamówienie - oświadczenie woli Klienta składane za pomocą Formularza Zamówienia i zmierzające bezpośrednio do zawarcia Umowy Sprzedaży Produktu lub Produktów ze Sprzedawcą.

Koszyk – element oprogramowania Sklepu, w którym widoczne są wybrane przez Klienta Produkty do zakupu, a także istnieje możliwość ustalenia i modyfikacji danych Zamówienia, w szczególności ilości produktów.

Produkt - dostępna w Sklepie rzecz ruchoma/usługa będąca przedmiotem Umowy Sprzedaży między Klientem a Sprzedawcą.

Umowa Sprzedaży - umowa sprzedaży Produktu zawierana albo zawarta między Klientem a Sprzedawcą za pośrednictwem Sklepu internetowego. Przez Umowę Sprzedaży rozumie się też - stosowanie do cech Produktu - umowę o świadczenie usług i umowę o dzieło.

§ 4

Informacje ogólne

1. Niniejszy Regulamin określa w szczególności:   

a) zasady rejestracji i korzystania z konta w ramach Sklepu internetowego;

b) warunki i zasady składania zamówień na produkty dostępne w ramach Sklepu Internetowego, drogą elektroniczną;

c) zasady zawierania umów sprzedaży z wykorzystaniem usług świadczonych w ramach Sklepu Internetowego.

2. Do korzystania ze Sklepu, w tym przeglądania asortymentu Sklepu oraz składania zamówień na Produkty, niezbędne są:

a) Urządzenie wyposażone w sprawny system operacyjny (Windows, Linux, IOS lub inny), umożliwiające dostęp do sieci Internet, z zainstalowaną przeglądarką internetową typu Google Chrome, Internet Explorer, Opera, Safari, Mozilla Firefox lub inną kompatybilną,

b) aktywne konto poczty elektronicznej (e-mail),

c) włączona obsługa plików cookies.

3. W celu skorzystania ze Sklepu Internetowego, Klient powinien we własnym zakresie uzyskać dostęp do urządzenia końcowego, z dostępem do Internetu.

4. Sprzedawca w najszerszym dopuszczalnym przez prawo zakresie nie ponosi odpowiedzialności za zakłócenia w tym przerwy w funkcjonowaniu Sklepu spowodowane siłą wyższą, niedozwolonym działaniem osób trzecich lub niekompatybilnością Sklepu internetowego z infrastrukturą techniczną Klienta.

§ 5

Zakładanie Konta w Sklepie

1. Aby założyć Konto w Sklepie, należy wypełnić Formularz rejestracji. Niezbędne jest podanie następujących danych: aktywny adres e-mail, imię, nazwisko oraz własne hasło.

2. Założenie Konta w Sklepie jest darmowe.

3. Logowanie się na Konto odbywa się poprzez podanie loginu i hasła ustanowionych w Formularzu rejestracji.

4. Klient ma możliwość w każdej chwili, bez podania przyczyny i bez ponoszenia z tego tytułu jakichkolwiek opłat usunąć Konto poprzez wysłanie stosownego żądania do Sprzedawcy, w szczególności za pośrednictwem poczty elektronicznej lub pisemnie na adresy podane w § 3.

§ 6

Zasady składania Zamówienia

W celu złożenia Zamówienia należy:

a) zalogować się do Sklepu

b) wybrać Produkt będący przedmiotem Zamówienia, jego ewentualne atrybuty (kolor, rodzaj, ilość) a następnie kliknąć przycisk „Do koszyka”;

c) wybrać metodę dostawy oraz jeden z dostępnych sposobów płatności i w zależności od sposobu płatności, opłacić zamówienie w określonym terminie,

d) kliknąć przycisk “Potwierdzam zamówienie”

§ 7

Metody płatności oraz ceny.

1. Klient może skorzystać z następujących metod płatności:

b) Płatności elektroniczne w systemie PayPal

c) Płatność kartą płatniczą - Visa, Visa Electron, MasterCard, MasterCard Electronic, Maestro - również za pomocą systemu PayPal.

2. Ceny Towarów podawane są w złotych polskich, euro lub dolarach, w zależności od tego którą z walut użytkownik ustawiła jako walutę domyślną.

§ 8

Oferowane metody dostawy

1. Klient może skorzystać z następujących metod dostawy lub odbioru zamówionego Produktu:

§ 9

Wykonanie umowy sprzedaży

1. Zawarcie Umowy Sprzedaży między Klientem a Sprzedawcą następuje po uprzednim złożeniu przez Klienta Zamówienia za pomocą Formularza zamówienia w Sklepie internetowym zgodnie z § 5 Regulaminu.

2. Po złożeniu Zamówienia Sprzedawca niezwłocznie potwierdza jego otrzymanie oraz jednocześnie przyjmuje Zamówienie do realizacji. Potwierdzenie otrzymania Zamówienia i jego przyjęcie do realizacji następuje poprzez przesłanie przez Sprzedawcę Klientowi stosownej wiadomości e-mail na podany w trakcie składania Zamówienia adres poczty elektronicznej Klienta, która zawiera oświadczenia Sprzedawcy o otrzymaniu Zamówienia i o jego przyjęciu do realizacji oraz potwierdzenie zawarcia Umowy Sprzedaży. Z chwilą otrzymania przez Klienta powyższej wiadomości e-mail zostaje zawarta Umowa Sprzedaży między Klientem a Sprzedawcą.

3. W przypadku płatności przelewem, płatności elektronicznych albo płatności kartą płatniczą, Klient obowiązany jest do dokonania płatności w terminie 7 dni kalendarzowych od dnia zawarcia Umowy Sprzedaży - w przeciwnym razie zamówienie zostanie anulowane.

4. Produkt zostanie wysłany przez Sprzedawcę w terminie wskazanym w jego opisie, w sposób wybrany przez Klienta podczas składania Zamówienia.

5. Początek biegu terminu dostawy Produktu do Klienta liczy się w następujący sposób:

a) W przypadku wyboru przez Klienta sposobu płatności przelewem- od dnia uznania rachunku bankowego Sprzedawcy.

b) W przypadku wyboru przez Klienta płatności elektronicznej lub płatności kartą płatniczą – od momentu otrzymania na adres e-mail, poprawnego potwierdzenia statusu płatności.

§ 10

Prawo odstąpienia od umowy

1. Klient może w terminie 100 dni odstąpić od Umowy Sprzedaży bez podania jakiejkolwiek przyczyny.

2. Bieg terminu określonego w ust. 1 rozpoczyna się od dostarczenia Produktu Klientowi lub wskazanej przez niego osoby.

3. Klient może odstąpić od Umowy, odsyłając Sprzedawcy zakupiony towar i informując sprzedawcę o tym fakcie mailowo, telefonicznie lub listem dosłączonym do zwracanego towaru. Do zachowania terminu odstąpienia od Umowy wystarczy wysłanie przez Konsumenta oświadczenia przed upływem tego terminu.

4. Skutki odstąpienia od Umowy:

a) W przypadku odstąpienia od Umowy Sprzedawca zwraca Klientowi niezwłocznie, nie później niż w terminie 14 dni od dnia otrzymania oświadczenia Klienta o odstąpieniu od Umowy, wszystkie dokonane przez niego płatności, w tym koszty dostarczenia rzeczy, z wyjątkiem dodatkowych kosztów wynikających z wybranego przez Klienta sposobu dostarczenia innego niż najtańszy zwykły sposób dostarczenia oferowany przez Sprzedawcę.

b) Zwrotu płatności Sprzedawca dokona przy użyciu takich samych metod płatności, jakie zostały przez Klienta użyte w pierwotnej transakcji, chyba że Klient wyraźnie zgodził się na inne rozwiązanie, które nie będzie się wiązało dla niego z żadnymi kosztami.

c) Sprzedawca może wstrzymać się ze zwrotem płatności do czasu otrzymania Produktu z powrotem lub do czasu dostarczenia mu dowodu jego odesłania, w zależności od tego, które zdarzenie nastąpi wcześniej.

d) Klient powinien odesłać Produkt na adres Sprzedawcy podany w niniejszym Regulaminie niezwłocznie, nie później niż 14 dni od dnia, w którym poinformował Sprzedawcę o odstąpieniu od Umowy. Termin zostanie zachowany, jeśli Konsument odeśle Produkt przed upływem terminu 14 dni.

§ 11

Reklamacje

1. Sprzedawca odpowiada wobec Klienta będącego konsumentem w rozumieniu art. 22[1] Kodeksu Cywilnego, z tytułu rękojmi za wady w zakresie określonym w Kodeksie Cywilnym, w szczególności w art. 556 oraz art. 556[1]-556[3] i kolejnych Kodeksu Cywilnego.

2. Reklamacje, wynikające z naruszenia praw Klienta gwarantowanych ustawowo, lub na podstawie niniejszego Regulaminu, należy kierować na office@kovalshop.com, Sprzedawca zobowiązuje się do rozpatrzenia każdej reklamacji w terminie do 10 dni. Nierozpatrzenie reklamacji w powyższym terminie oznacza uznanie jej za uzasadnioną.

3. Sprzedawca - Bzik Tomasz Kowal jest producentem dostępnych w Sklepie towarów.

§ 12

Reklamacje w zakresie świadczenia usług drogą elektroniczną

1. Sprzedawca podejmuje niezbędne działania w celu zapewnienia w pełni poprawnego działania Sklepu, w takim zakresie, jaki wynika z aktualnej wiedzy technicznej i zobowiązuje się usunąć w najkrótszym możliwym terminie wszelkich nieprawidłowości zgłoszonych przez Klientów.

2. Klient zobowiązany jest niezwłocznie powiadomić Sprzedawcę o wszelkich nieprawidłowościach lub przerwach w funkcjonowaniu Sklepu.

3. Nieprawidłowości związane z funkcjonowaniem Sklepu Klient może zgłaszać pocztą elektroniczną na adres: office@kovalshop.com

4. W zgłoszeniu reklamacyjnym Klient powinien podać swoje imię i nazwisko, adres do korespondencji, rodzaj i datę wystąpienia nieprawidłowości związanej z funkcjonowaniem Sklepu.

5. Sprzedawca zobowiązuje się do rozpatrzenia każdej reklamacji w terminie do 10 dni. Nierozpatrzenie reklamacji w powyższym terminie oznacza uznanie jej za uzasadnioną.

§ 13

Pozasądowe sposoby rozpatrywania reklamacji i dochodzenia roszczeń

1. Szczegółowe informacje dotyczące możliwości skorzystania przez Konsumenta z pozasądowych sposobów rozpatrywania reklamacji i dochodzenia roszczeń oraz zasady dostępu do tych procedur dostępne są w siedzibach oraz na stronach internetowych powiatowych (miejskich) rzeczników konsumentów, organizacji społecznych, do których zadań statutowych należy ochrona konsumentów, Wojewódzkich Inspektoratów Inspekcji Handlowej oraz pod następującymi adresami internetowymi Urzędu Ochrony Konkurencji i Konsumentów:

2. Konsument posiada następujące przykładowe możliwości skorzystania z pozasądowych sposobów rozpatrywania reklamacji i dochodzenia roszczeń:

a) Konsument uprawniony jest do zwrócenia się do stałego polubownego sądu konsumenckiego, o którym mowa w art. 37 ustawy z dnia 15 grudnia 2000 r. o Inspekcji Handlowej (Dz.U. z 2014 r. poz. 148 z późn. zm.), z wnioskiem o rozstrzygnięcie sporu wynikłego z Umowy zawartej ze Sprzedawcą.

b) Konsument uprawniony jest do zwrócenia się do wojewódzkiego inspektora Inspekcji Handlowej, zgodnie z art. 36 ustawy z dnia 15 grudnia 2000 r. o Inspekcji Handlowej (Dz.U. z 2014 r. poz. 148 z późn. zm.), z wnioskiem o wszczęcie postępowania mediacyjnego w sprawie polubownego zakończenia sporu między Konsumentem a Sprzedawcą.

c) Konsument może uzyskać bezpłatną pomoc w sprawie rozstrzygnięcia sporu między nim a Sprzedawcą, korzystając także z bezpłatnej pomocy powiatowego (miejskiego) rzecznika konsumentów lub organizacji społecznej, do której zadań statutowych należy ochrona konsumentów (m.in. Federacja Konsumentów, Stowarzyszenie Konsumentów Polskich).

§ 14

Polityka prywatności.

Niniejsza Polityka Prywatności określa zasady przetwarzania i ochrony danych osobowych przekazanych przez Użytkowników w związku z korzystaniem przez nich ze Sklepu Internetowego KovalShop.

1. Administratorem danych osobowych zawartych w serwisie jest:

2. W trosce o bezpieczeństwo powierzonych nam danych opracowaliśmy wewnętrzne procedury i zalecenia, które mają zapobiec udostępnieniu danych osobom nieupoważnionym. Kontrolujemy ich wykonywanie i stale sprawdzamy ich zgodność z odpowiednimi aktami prawnymi - Rozporządzeniem Parlamentu Europejskiego i Rady (UE) 2016/679 z dnia 27 kwietnia 2016 r. w sprawie ochrony osób fizycznych w związku z przetwarzaniem danych osobowych, ustawą o świadczeniu usług drogą elektroniczną, a także wszelkiego rodzaju aktach wykonawczych i aktach prawa wspólnotowego.

3. Dane Osobowe przetwarzane są na podstawie zgody wyrażanej przez Użytkownika oraz w przypadkach, w których przepisy prawa upoważniają Administratora do przetwarzania danych osobowych na podstawie przepisów prawa lub w celu realizacji zawartej pomiędzy stronami umowy.

4. Serwis realizuje funkcje pozyskiwania informacji o użytkownikach i ich zachowaniach w następujący sposób:

a) poprzez dobrowolnie wprowadzone w formularzach informacje

b) poprzez gromadzenie plików “cookies”

5. Serwis zbiera informacje dobrowolnie podane przez użytkownika.

6. Dane podane w formularzu są przetwarzane w celu :

a) umożliwienia świadczenia usługi drogą elektroniczną oraz pełnego korzystania ze sklepu internetowego, w tym realizowania zamówień i płatności za produkty zakupione w sklepie KovalShop

b) obsługi zgłoszeń reklamacyjnych i zwrotów;

c) obsługi zapytań, które są kierowane do sklepu (np. przez formularz kontaktowy);

d) kontaktu związanego ze sprzedażą produktów;

e) zapewnienie prawidłowej obsługi i realizacji usług płatniczych.

7. Administrator dokłada wszelkich starań, aby zapewnić ochronę danych osobowych przed ich przypadkowym czy umyślnym zniszczeniem, przypadkową utratą, zmianą, nieuprawnionym ujawnieniem, wykorzystaniem czy dostępem, zgodnie ze wszystkimi obowiązującymi przepisami.

8. Do danych zawartych w formularzu przysługuje wgląd osobie fizycznej, która je tam umieściła. W związku z przetwarzaniem danych osoba ta ma prawo do:

a) żądania od Administratora dostępu do Twoich danych osobowych,

b) żądania od Administratora sprostowania Twoich danych osobowych,

c) żądania od Administratora usunięcia Twoich danych osobowych,

d) żądania od Administratora ograniczenia przetwarzania Twoich danych osobowych,

e) wniesienia sprzeciwu wobec przetwarzania Twoich danych osobowych,

f) wniesienia skargi do organu nadzorczego.

Z praw wskazanych powyżej można skorzystać poprzez:

10. Zastrzegamy sobie prawo do zmiany w polityce ochrony prywatności serwisu, na które może wpłynąć rozwój technologii internetowej, ewentualne zmiany prawa w zakresie ochrony danych osobowych oraz rozwój naszego serwisu internetowego. O wszelkich zmianach będziemy informować w sposób widoczny i zrozumiały.

§ 15

Postanowienia końcowe

1. Umowy zawierane poprzez Sklep internetowy zawierane są w języku polskim.

2. Sprzedawca zastrzega sobie prawo do dokonywania zmian Regulaminu z ważnych przyczyn to jest: zmiany przepisów prawa, zmiany sposobów płatności i dostaw - w zakresie, w jakim te zmiany wpływają na realizację postanowień niniejszego Regulaminu. O każdej zmianie Sprzedawca poinformuje Klienta z co najmniej 7 dniowym wyprzedzeniem.

3. W sprawach nieuregulowanych w niniejszym Regulaminie mają zastosowanie powszechnie obowiązujące przepisy prawa polskiego, w szczególności: Kodeksu cywilnego; ustawy o świadczeniu usług drogą elektroniczną; ustawy o prawach konsumenta, ustawy o ochronie danych osobowych.

4. Klient ma prawo skorzystać z pozasądowych sposobów rozpatrywania reklamacji i dochodzenia roszczeń. W tym celu może złożyć skargę za pośrednictwem unijnej platformy internetowej ODR dostępnej pod adresem: http://ec.europa.eu/consumers/odr/.
